This Legal Notice governs access to and use of the website funpartyai.com, owned by Dreamsite SL (hereinafter, "FunPartyAI" or "the Owner").

FunPartyAI is a service that generates personalized children's birthday invitations using artificial intelligence. The user uploads photographs of the minor, selects a theme and provides the event details, and the system generates a cartoon-style invitation optimized for sharing on WhatsApp.

Accessing the Website grants the status of user and implies full and unreserved acceptance of every provision included in this Legal Notice, as well as in the Privacy Policy, the Terms and Conditions and the Cookie Policy.

3. Intellectual and industrial property

All contents of the Website, including but not limited to: texts, photographs, graphics, images, icons, technology, software, logos, trademarks, trade names, designs and any other elements subject to intellectual and industrial property rights, are the property of FunPartyAI or of third parties who have authorized their use, and are protected by Spanish law and international treaties.

The reproduction, distribution, public communication, transformation or any other activity involving the contents of the Website is prohibited without the prior written consent of FunPartyAI, except in the cases provided for by law.

Images generated by the service are governed by the Terms and Conditions.

4. AI-generated content

In accordance with Regulation (EU) 2024/1689 (Artificial Intelligence Act), users are informed that the invitations generated by FunPartyAI are synthetic content created by artificial intelligence. Specifically, the service uses generative AI models to transform the provided photographs into cartoon-style illustrations and to compose the invitation design.

Generated images may include metadata identifying them as AI-generated content.

5. Conditions of use

The user agrees to use the Website and FunPartyAI's services in accordance with the law, this Legal Notice, the other conditions and policies published on the Website, generally accepted morals and good customs, and public order.

In particular, the user agrees to:

• Not use the service for unlawful or fraudulent purposes or purposes contrary to this Legal Notice.
• Not upload images of minors over whom they do not hold parental authority or legal guardianship.
• Not upload content that is illegal, offensive, defamatory, obscene, or that infringes the rights of third parties.
• Not attempt unauthorized access to FunPartyAI's computer systems.
• Not use the service in a way that may damage, overload, impair or prevent the normal operation of the Website.

FunPartyAI reserves the right to withdraw, suspend or cancel access to the service for any user who breaches these conditions.

6. Liability

FunPartyAI is not liable for:

The Website may contain links to third-party websites (Stripe for payments, social networks, etc.). FunPartyAI assumes no responsibility for the content, privacy policies or practices of such websites.

8. Personal data protection

Since the service involves processing photographs of minors, FunPartyAI applies the highest protection guarantees, including verifiable parental consent and automatic deletion of the photographs within 24 hours.

9. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of Alcobendas (Madrid, Spain).

However, where the user qualifies as a consumer, jurisdiction shall correspond to the consumer's place of residence.

FunPartyAI reserves the right to amend this Legal Notice at any time. Amendments take effect from the moment they are published on the Website.
