Terms and Conditions

These Terms and Conditions (hereinafter, "T&C") govern the contracting and use of the service offered by Dreamsite SL (hereinafter, "FunPartyAI") through the website funpartyai.com.

By using our service, the user declares that they have read, understood and accepted these T&C, as well as the Privacy Policy, the Legal Notice and the Cookie Policy.

2. Service description

FunPartyAI is a service that generates personalized children's birthday invitations using artificial intelligence:

1. Verification. The user verifies their email address.
2. Photo upload. The user uploads up to 3 photographs of the minor.
3. Theme selection. The user chooses a theme (soccer, princesses, superheroes, etc.).
4. Event details. The minor's name, age, date, time and place.
5. Parental consent. The user declares that they are the parent or legal guardian of the minor and gives their explicit consent.
6. Generation. The system processes the photographs with generative AI models to create the invitation.
7. Download. The user receives the invitation optimized for WhatsApp.

Transparency about AI use: The invitations are synthetic content created by artificial intelligence, in accordance with Regulation (EU) 2024/1689 (AI Act).

3. Plans and prices

3.1. Free tier

• 1 invitation with the FunPartyAI watermark.
• Requires email verification.
• Free of charge.

3.2. Basic

• 1 HD invitation without watermark + 3 variations.
• Price: €4.99 (VAT included).
• One-time payment, no subscription.

3.3. Party Pack

• Invitation + thank-you card + poster + 3 variations.
• Price: €12.99 (VAT included).
• One-time payment, no subscription.

All prices include VAT at the rate in force in Spain (21%). FunPartyAI reserves the right to change prices. Changes will not affect orders already confirmed.

4. Purchase and payment process

1. The user selects the paid plan.
2. The user reviews the order summary (description + total price including VAT).
3. The user accepts the T&C and the Privacy Policy via an active checkbox.
4. The user consents to the generation starting immediately (see section 5).
5. The user proceeds to payment.
6. Once the payment is confirmed, the system starts the generation.

Payments are processed securely through Stripe. FunPartyAI does not store card data. FunPartyAI will issue an invoice at the user's request by emailing legal@funpartyai.com.

5. Right of withdrawal

5.1. Exclusion of the right of withdrawal

In accordance with article 103, paragraph m), of Spanish Royal Legislative Decree 1/2007, the right of withdrawal shall not applyto the supply of digital content not provided on a tangible medium where performance has begun with the consumer's prior express consent and with the knowledge that they thereby lose their right of withdrawal.

5.2. Express consent before payment

Before proceeding to payment, the user must expressly accept:

"I agree that the generation of my invitation starts immediately after payment and I understand that, by doing so, I waive my right of withdrawal under article 103.m) of Spanish Royal Legislative Decree 1/2007."

5.3. Conformity guarantee

If the service is not performed correctly (system error), the user is entitled to:

1. A new performance of the service at no additional cost.
2. If that is not possible, a full refund of the amount paid.

6. Intellectual property

6.1. Photographs uploaded by the user

The user declares and warrants that:

• They own the photographs or are authorized to use them.
• The photographs correspond to the minor over whom they hold parental authority or legal guardianship.
• They authorize FunPartyAI to process those photographs exclusively for the contracted generation.

The original photographs are automatically deleted within 24 hours.

6.2. Generated invitations

• The user receives a broad usage license — non-exclusive, worldwide, free of charge and indefinite — to use, share, print and distribute the invitation for personal, non-commercial purposes.
• FunPartyAI does not claim exclusive rights over the generated invitations.
• Ownership of intellectual property rights over AI-generated images is an evolving legislative matter in the EU.

7. User obligations

• Provide truthful and up-to-date information.
• Be over 18 years of age.
• Be the parent or legal guardian of the minor whose photographs they upload.
• Not use the service for unlawful or fraudulent purposes.
• Not upload photographs of minors over whom they do not hold parental authority or guardianship.
• Not use the service in an automated way (bots, scrapers).

8. Service limitations

The result depends on the quality, lighting and resolution of the photographs provided. FunPartyAI does not guarantee that the result will fully satisfy the user's aesthetic expectations.

To the maximum extent permitted by law, FunPartyAI's total liability shall not exceed the amount paid by the user for the service giving rise to the claim.

9. Termination and cancellation

The user may stop using the service at any time and request the deletion of their data by emailing privacidad@funpartyai.com or by using the "Delete my data" button.

10. Applicable law and jurisdiction

These T&C are governed by Spanish law. For the resolution of disputes, the parties submit to the Courts and Tribunals of Alcobendas (Madrid, Spain).

Where the user qualifies as a consumer, jurisdiction shall correspond to the consumer's place of residence.

11. Partial invalidity

If any clause is declared void, the remaining clauses shall remain in full force.

12. Amendments

FunPartyAI reserves the right to amend these T&C. If the changes substantially affect the user's rights, the user will be notified by email 15 days in advance.
